1. Acceptance and scope
By accepting a quotation, paying a deposit, making a full payment or instructing TK Web Studio to begin work, you agree to these terms together with the approved quotation, project scope and any written project-specific terms.
If a quotation contains a term that is more specific than this page, the quotation applies to that project. Nothing in these terms removes rights that cannot lawfully be excluded under South African law.
2. Quotations and project scope
Quotations describe the agreed deliverables, price, deposit, included pages or features, revision allowance and estimated timeline. Work outside the confirmed scope, including extra pages, redesigns, integrations or content work, may require a revised quotation or written change approval.
Prices shown on the website are starting prices. Custom applications, payment gateways, booking systems, dashboards, automation and third-party integrations are quoted according to the final scope.
3. Deposits and payment
The stated deposit is due before development begins unless a quotation says otherwise. The remaining balance is due before the website is launched, transferred, handed over or connected to the customer's live domain.
Payments may be processed through Paystack or another approved payment method. Customers must use accurate billing details and may not attempt unauthorised, fraudulent or reversed payments.
Late or unpaid amounts may pause work, support, hosting or launch activity until the account is brought up to date.
4. Customer responsibilities
The customer must provide accurate instructions, content, images, branding, account access and approvals within a reasonable time. The customer confirms that supplied material may lawfully be used and does not infringe another person's rights.
Project dates may move when content, access, feedback, payment or approval is delayed. TK Web Studio is not responsible for claims arising from customer-supplied content, instructions or account credentials.
5. Reviews, revisions and approval
Customers receive a preview or review opportunity according to the quotation. Feedback should be clear, consolidated and submitted within the requested review period. Revisions beyond the included rounds or outside the approved scope may be quoted separately.
Written approval, live use of the work, or failure to report a clear issue within the agreed review period may be treated as acceptance of the relevant project stage, without limiting rights that apply by law.
6. Delivery, launch and handover
Delivery is electronic and may include a preview link, published website, files, credentials or documented handover. Estimated delivery periods appear in the Delivery Timeline and the customer quotation.
Launch or handover takes place after final approval, payment and access requirements are complete. Third-party reviews, domain changes, payment provider approval and service outages may affect timing.
7. Intellectual property
The customer keeps ownership of content and branding they provide. After full payment, the customer receives the agreed rights to the final custom website design and project deliverables described in the quotation.
TK Web Studio retains ownership of pre-existing methods, reusable code, templates, utilities, know-how and internal systems. Third-party software, fonts, plugins, images and services remain subject to their own licences.
Unless the customer requests confidentiality in writing before launch, TK Web Studio may identify the completed website as portfolio work without disclosing confidential business information.
8. Hosting, domains and third-party services
Hosting, domain registration, email, paid plugins and other third-party services are separate unless expressly included in the quotation. Domain names should, where practical, be registered in the customer's name or account.
Third-party platforms control their own availability, pricing, security checks, approval decisions and terms. TK Web Studio will provide reasonable assistance but cannot guarantee approval or uninterrupted operation of an external service.
Managed hosting or care services may be suspended for non-payment, serious security risk, illegal use or material breach after reasonable notice where circumstances allow.
9. Service standards and liability
TK Web Studio will provide services with reasonable care and skill. We do not guarantee a particular sales result, search-engine ranking, amount of traffic, platform approval or uninterrupted third-party service.
To the extent permitted by law, TK Web Studio is not responsible for indirect or consequential loss, lost profit, customer-caused errors, unsupported modifications, credential misuse or third-party outages. Any limitation is subject to rights and remedies that cannot lawfully be excluded.
10. Cancellation, refunds and disputes
Project cancellations are handled under the Cancellation Policy. Refund requests are handled under the Refund Policy.
Customers should first contact TK Web Studio so the issue can be investigated and resolved. The parties should try in good faith to settle disputes through written communication before taking formal action.
11. Governing law and contact
These terms are governed by the laws of the Republic of South Africa. TK Web Studio may update them when services or legal requirements change. The effective date above identifies the current version.
